1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your access to and use of the ZaadhaJobs mobile application and website (the "Platform"). The Platform is owned and operated by ZaadhaJobs, located at Aluva, Ernakulam – 683101, Kerala, India.

By creating an account or using the Platform, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

To use this Platform, you must be at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872. By using ZaadhaJobs, you warrant that you meet these criteria.

3. Platform Role & Intermediary Status

A. We are an Intermediary

ZaadhaJobs operates as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. In accordance with Section 79 of the Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, ZaadhaJobs is entitled to safe harbour protection for third-party user-generated content, including job postings and in-app communications, provided that it observes due diligence requirements and does not initiate, select, or modify such content, and complies with applicable takedown obligations under law.

B. No Liability for Employment Disputes

We are not a party to any agreement, hiring outcome, or payment arrangement made between users. ZaadhaJobs does not endorse, recommend, or guarantee any user, employer, or job listing on the Platform. We do not guarantee job availability, employer authenticity, or the credentials of any worker. Workplace safety, wage payments, and legal compliances are the sole responsibility of the employer and worker.

C. No Background Verification & Personal Safety

ZaadhaJobs does not verify the identity, background, or credentials of users or employers. Users are solely responsible for their interactions, including meeting in person. ZaadhaJobs advises users to take necessary safety precautions and perform their own due diligence before commencing work.

4. User Generated Content (UGC) & Acceptable Use

You are solely responsible for the content you create on the Platform. We maintain a zero-tolerance policy for abuse and scams to comply with Google Play Developer Policies and Indian Law.

A. Prohibited Content

You agree NOT to post content that involves:

• Scams & Fees: Asking job seekers for "registration fees," "security deposits," "uniform charges," or any upfront payment. ZaadhaJobs is 100% free for job seekers.
• Sexual Content: Escort services, adult entertainment, or sexually explicit material.
• Discrimination: Postings showing preference based on caste, religion, gender, or community.
• Illegal Activities: Work involving human trafficking, child labor, or sale of illegal goods.

B. Mandatory Content Policy (Due Diligence)

In accordance with Rule 3(1)(b) of the IT Rules 2021, you are strictly prohibited from sharing any information that:

• Belongs to another person and to which the user does not have any right.
• Is defamatory, obscene, pornographic, pedophilic, or invasive of another's privacy.
• Is insulting or harassing on the basis of gender, libelous, racially or ethnically objectionable.
• Relates to or encourages money laundering, gambling, or is contrary to the laws of India.

C. In-App Communication (Voice Calls)

Users must communicate respectfully. Harassment, threats, and abusive language are strictly prohibited. ZaadhaJobs is not responsible for any communication exchanged between users or for any recordings made without consent.

5. Payments and Fraud

ZaadhaJobs is not responsible for any financial transactions between users. ZaadhaJobs will never ask for payments from job seekers. Any request for money by any user or employer should be treated as fraud and reported immediately.

6. Trust & Safety: Reporting and Blocking

• Blocking: You can block any user at any time to prevent them from viewing your jobs or calling you.
• Reporting: Suspicious activity can be reported in-app for prompt review by our team.
• Termination: We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice, for violations of these Terms.

7. Account Security

You are responsible for the confidentiality of your Google Sign-In credentials and OTPs. Notify us immediately of any unauthorized account use.

8. Intellectual Property

All software, logos, and technology underlying the Platform are the property of ZaadhaJobs. You grant us a non-exclusive license to display the content you post for the operation of our services.

9. Disclaimers and Limitation of Liability

"AS-IS" Basis: The Platform is provided without warranties regarding job availability or uptime. ZaadhaJobs does not provide insurance, workers' compensation, or any statutory benefits.

ZaadhaJobs does not guarantee the accuracy, completeness, or reliability of any user-generated content on the Platform.

Limitation of Liability: To the maximum extent permitted by law, ZaadhaJobs shall not be liable for any indirect damages, personal injury, lost wages, or disputes arising out of your use of the Platform.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the competent courts in Ernakulam, Kerala.

11. Grievance Officer

In compliance with the Information Technology Rules, 2021, if you have a complaint regarding content on the Platform, please contact our Grievance Officer. We acknowledge receipt within 24 hours and resolve grievances within 15 days.

12. Amendments to Terms

We may modify these Terms at any time. Significant changes will be communicated via in-app notifications. Continued use of the Platform constitutes acceptance of the updated Terms.

13. Entire Agreement

These Terms constitute the entire agreement between you and ZaadhaJobs regarding the use of the Platform.
